Sample Companion Sales Agreement

 

Just like how good fences make good neighbors, sales agreements, required by the American Kennel Club for record keeping compliance, make good sense. They clearly state the terms and conditions of the understanding being entered in to so that both the buyer and seller know what to expect as well as what is expected of them.

Although we always place our babies with the intention of a lifetime of love from their new owners we understand that there may come a time when crisis strikes and a buyer may be unable to keep one of our dogs, in such an event for any reason we are happy to take back a dog at any point throughout his/her entire life. We never ever want a Wagsmore dog to end up in an Animal shelter!

The following conditions have been mutually agreed to by both parties:

• The price of the above mentioned Dachshund shall be $ 0000.00 payable upon receipt of said dog.
• The breeder agrees to furnish the buyers with an accurate pedigree upon delivery of the dog.
• The breeder will withhold registration papers on the above mentioned Dachshund until the buyers furnish proof in the form of a written statement from their veterinarian, on his or her official letterhead, of the spaying or neutering of the above mentioned dog. Under no circumstances will AKC registration papers be issued to the dog until proof, as noted above, is in the possession of the breeder. The buyer has exactly one (1) year from the time of whelping in which to comply with this portion of this agreement, after which time the AKC papers will be null and void.
• Should the buyers be unable or unwilling to keep the above mentioned Dachshund, they shall return the dog to the breeder. If this is within 30 days of sale,a full refund shall be given. After 30 days the breeder will refund the amount of resale to any other party (less expenses incurred) to original buyers.
• The breeder agrees to deliver the Dachshund to the buyers in good health, with a record of medical treatment the dog has received and guarantee the dog to be free of contagious or congenital diseases at the time of purchase.
• The buyers agree to have the dog examined by a veterinarian within ten (10) days of purchase.
• The buyers agree to annual veterinary checkups, including keeping all immunizations current according to AVMA guidelines, to provide adequate housing according to state law, to confine the dog to a fenced in yard, kennel run or house.
• Should this dog be used for breeding purposes other than agreed upon here by both parties,the buyer shall be held in breach of contract which will be construed as damaging to the sellers (breeders) and legal recourse will be taken in the amount of five thousand dollars ($5,000.00) in addition to all court, lawyer and other associated fees.
• This dog is being sold as a companion animal not as a show prospect, therefore I do not make any claims nor any guarantees or warranties as to this dogs show potential.
• This agreement shall be deemed to be executed in the State of California and construed and interpreted according to the laws of the state of California. Any controversy or claim arising out of or relating to the performance of this agreement shall be settled and enforced in the state and federal courts (depending upon the jurisdiction) located within the state of California.
• This agreement constitutes the entire understanding between the BREEDER and the BUYER and shall supersede any and all previous understandings and agreements pertaining to the subject matter of this agreement. Any changes or amendments to this agreement must be in writing and agreed to by both parties.
• In no event shall the amount of any refund, reimbursement or liability on the part of the breeder to the buyer be greater than the purchase price of the dog.
